Zoning By-law Amendment Application Z/01/25

Take Notice that the Council of the Corporation of the Township of Adjala-Tosorontio has received applications under the Planning Act, R.S.O. 1990, as amended, for a Zoning By-law Amendment for property located on on CON 3 N PT LOT 24, municipally addressed as 3911 Concession Road 3, in the Township of Adjala-Tosorontio.

Synopsis: A site-specific Zoning By-law Amendment to remove residential use permissions from the remnant agricultural parcel, ensuring compliance with policies for surplus dwelling severances. Additionally, relief is sought for the residential lot's size of 1.44 ha, whereas 0.4 to 1 ha is permitted as per zoning by-law 03-57.

And take notice the Council of the Corporation of the Township of Adjala-Tosorontio will hold a Hybrid Public Meeting on Wednesday, February 12, 2025, with the open session starting at 6:30 p.m.

There will be a commenting period from January 23, 2025 to February 6, 2025 on the mentioned reports in such a way that the public can participate by attending or sending their comments through letters, faxes, emails, voice messages, video clips or by registering with the Clerk’s Department, to speak at the public meeting. Comments received after the commenting period will not be placed on the agenda, however they will be received by the Clerk’s Department and kept on record with the application.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of Adjala-Tosorontio to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Adjala-Tosorontio before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Adjala-Tosorontio before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Explanation of the Purpose and Effect of the Proposed Zoning By-law Amendment Z/01/25 (3911 Concession Road 3)

An application has been submitted for a Zoning By-law Amendment for property located on Con 3 N PT Lot 24, municipally addressed as 3911 Concession Road 3 in the Township of Adjala-Tosorontio.

The Zoning By-law Amendment (ZBA) application proposes to rezone the subject lands to facilitate the severance of a 1.44-hectare (3.55-acre) surplus dwelling parcel with 62 meters of frontage on Concession Road 3, whereas Zoning By-law 03-57 requires surplus dwelling parcels to be between 0.4 hectares and 1 hectare in size. The retained agricultural parcel would be 8.4 hectares, whereas a minimum of 36 hectares is required, with 82 meters of frontage, whereas 150 meters is required. The ZBA would also rezone the retained lands to prohibit residential uses and ensure their designation for agricultural purposes only.

A site-specific Zoning By-law Amendment (ZBA) is proposed to remove residential use permissions from the agricultural lands to be sold to H.J Vander Zaag Farms as part of their farm consolidation. The ZBA application will be processed prior to the Consent application in this case.
